SECTION 15 - SEVERABILITY In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 16 - TERMINATION The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
SECTION 17 - ENTIRE AGREEMENT The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
SECTION 20 - GARAGE WORK
When booking in for a fitting, we must take a minimum of a 25% deposit to secure your slot in the workshop. These deposits are non-refundable.
Where works are to be carried out within a garage, workshop, showroom, or similar environment, the Client shall ensure that the area is safe, accessible, and suitable for Genome Design to carry out the agreed services.
The Client is responsible for ensuring that all vehicles, machinery, equipment, and other obstructions are removed or adequately repositioned prior to the commencement of works, unless otherwise agreed in writing. Genome Design reserves the right to delay, suspend, or reschedule works where access is restricted or where conditions are deemed unsafe. Any additional time, labour, or costs incurred as a result of restricted access, delays, or unsuitable working conditions may be chargeable to the Client.
Genome Design will exercise reasonable care when working in proximity to vehicles, equipment, fixtures, or surfaces; however, Genome Design shall not be liable for any damage to vehicles, machinery, tools, or other property located within the workspace unless such damage is directly caused by proven negligence on the part of Genome Design.
Genome Design shall not be responsible for any pre-existing damage, defects, weakened surfaces, or structural issues within the garage or surrounding environment. Any damage arising as a result of such pre-existing conditions shall remain the responsibility of the Client.
Garages and workshop environments may contain contaminants, including but not limited to oil residues, grease, dust, moisture, temperature variations, and uneven or unstable surfaces. Genome Design shall not be liable for any issues relating to adhesion, installation performance, material longevity, or finish quality where such environmental factors are present and beyond its control.
Where additional preparation, cleaning, removal of fixtures, or modifications to the workspace are required in order to complete the works safely or effectively, Genome Design reserves the right to charge for such additional work.
The Client accepts that Genome Design cannot guarantee installation outcomes where environmental or structural conditions fall outside normal installation parameters.
Genome Design reserves the right to suspend or terminate work at any time where a Client or any individual present on site behaves in a rude, aggressive, abusive, threatening, or otherwise inappropriate manner towards our staff or contractors. In such circumstances, any work completed up to that point will remain chargeable and Genome Design shall not be liable for any delays or costs resulting from the termination of services.
SECTION 21 – CLIENT-SUPPLIED PARTS, HARDWARE, AND MODIFICATIONS
Where the Client supplies parts, components, or hardware for installation, modification, or fitting, including but not limited to exhaust systems, body components, wheels, suspension parts, or other aftermarket items, the Client acknowledges that Genome Design has not manufactured, tested, or approved such products.
Genome Design shall not be responsible for the compatibility, fitment, performance, legality, safety, or durability of any Client-supplied parts. Any advice or recommendations provided by Genome Design regarding suitability, installation, or potential issues are given in good faith but remain the responsibility of the Client.
Where the Client chooses to proceed against the advice or recommendation of Genome Design, the Client accepts full responsibility for any resulting issues including, but not limited to, poor fitment, mechanical interference, noise, vibration, warning lights, damage to other components, or reduced vehicle performance.
Genome Design shall not be liable for any loss, damage, or additional costs arising from the installation or attempted installation of Client-supplied parts that are incompatible, incorrectly specified, defective, or otherwise unsuitable.
If a Client-supplied product cannot be installed, fitted correctly, or requires additional fabrication, modification, or labour in order to complete the work, Genome Design reserves the right to charge additional labour costs or to refuse installation.
Genome Design accepts no responsibility for manufacturer defects, warranty issues, or product failures relating to Client-supplied parts. Any such matters remain solely between the Client and the original supplier or manufacturer.
The Client acknowledges that once installation work has commenced on Client-supplied parts, labour charges remain payable regardless of the final outcome of the installation.
SECTION 22 - CANCELLATION POLICY
We understand that circumstances may change and appointments may need to be cancelled or rescheduled. We kindly ask that you provide as much notice as possible so that the appointment can be offered to other customers.
Cancellations or rescheduling requests made within five (5) working days of the scheduled appointment date will incur a cancellation charge of 20% of the total booking value, with a minimum charge of £100.
Deposits paid to secure a booking are non-refundable. In certain circumstances, and at the sole discretion of Genome Design, deposits may be transferred to a new booking date provided sufficient notice is given.
Failure to attend a scheduled appointment without prior notice may result in the full loss of the deposit and additional cancellation charges where applicable.
